Template letter for opposition to the emergency powers to Senators

Subject – PUBLIC HEALTH BILL TO BE DEBATED ON FRIDAY THE 3RD DECEMBER 2021

Dear Senator,

A relentless Campaign for Truth and Civil rights is underway. You can choose where you wish to stand, my position is that I would encourage you to act with the integrity of the office you hold. Please objectively consider these questions and reply in kind.

The number of Senators in the Seanad who can stand tall on this debacle is very small. Fairness and equality is a right and one which should be taken seriously. As the Upper house of Parliament in Ireland you are expected to provide oversight and analysis of what happens in the Dail and call out and oppose legislation pushed through which is against the interests of the People. These powers are not needed to adequately deal with the Public Health situation.

Questions

1.  What risk assessment, or risk benefit analysis, has been presented to the Dail ahead of Friday’s debate, to validate the necessity for further impositions of ’emergency’ measures such as mask wearing, continuing vaccine roll outs, vaccine passports, and the detention of infected persons. On the basis of what hard data have the necessity for such measures been evaluated?.

What has the government presented to the Dail and the Senate by way of detailed, supporting data and data analysis where they now propose to extend and expand on existing emergency measures in a new law, restricting if not actually suspending individual rights and freedoms as guaranteed under the Irish Constitution.

Has the Dail, and every TD, looked for such a validating, comprehensive, thorough and quality assessment prior to the debate?

And presuming that this risk/benefit assessment has been obtained before the debate takes place, will it be made public ahead of any further Emergency legislation being imposed on the public?

2. What checks and balances will our public representatives require in respect of powers given to the Minster for Health in particular, in issuing Regulations and in expanding the scope of measures and impositions included in the proposed law, by way of regulations in the future. Is it proposed that he will be permitted to continue issuing far reaching Regulations, without debate  or scrutiny in the Dail, as has been the case since the the pandemic was declared and the Health Act 2020 was signed into law in February 2021?

3. Is it the intention to include people vaccinated once, twice, three times or more  as well as unvaccinated people in the cohort of people potentially to be detained in designated quarantine facilities, where they test positive on PCR or antigen tests or are deemed to be close contacts of infected persons? Will this be made clear to the public prior to the new act being passed?

We are entitled to this information, we are entitled to insist on it prior to another piece of Emergency legislation being passed into law, twenty one months after a pandemic was presented as necessitating emergency legislation, effectively placing our democracy on hold.
